3230 Discipline Procedures

3231 Disciplinary Letters

3231.1
The principal/superintendent may address any failure to perform specific responsibilities. In addition to discussing the situation with the employee, the administrator may write a disciplinary letter to the employee with copies sent to the employee's personnel file and/or the Board.

3231.2
The letter may state the specific problem and the requirements for action that the employee is being requested to perform.

3231.3
If the employee does not perform the required action after receiving the letter, either a second letter may be written or the employee may be dismissed.

3231.4
The letter will be removed from the employee's file two years after the date it was written at the discretion of the Board.

3232 Suspension

3232.1
The administrator may immediately suspend an employee for any of the following reasons.

  • Immoral or unprofessional conduct
  • Commission, aiding or advocating criminal acts
  • Dishonesty
  • Incompetence or evident unfitness for service
  • Physical or mental condition unfitting them to instruct or associate with children
  • Continued violation or refusal to obey XCS rules or regulations
  • Conviction for a felony or any crime involving moral turpitude.

3232.2
Notice of suspension may be verbal or in a letter delivered in person or by certified mail to the last known address.

3232.3
The employee may request a hearing with the Board within two days by writing and giving a request to the superintendent. A person's failure to request a hearing within that time shall result in the loss of the right to such a hearing.

3232.4
The superintendent will write a summary of the suspension to be placed in the employee's personnel file. The summary shall include the reasons for the suspension, the names of any witnesses, and the dates of the suspension.

3232.5
If the employee is reinstated to his/her position, the summary of the suspension may be removed from the employee's file two years after later at the discretion of the Board.

3233 Involuntary Termination of Employment

3233.1
The superintendent may dismiss a teacher after securing approval of the action from the Board or its representative for any of the reasons listed in Section 3232.1 or failure to fulfill their contract requirements. Classified employees may be dismissed immediately without Board approval for the same reasons.

3233.2
Notice of dismissal shall be in writing and delivered in person or by certified mail to the last known address.

3233.3
The employee may request a hearing with the Board within seven days by writing and giving a request to the person issuing the notice of dismissal. A person's failure to request a hearing within that time shall result in the loss of the right to such a hearing.

3233.4
The superintendent will write a summary of the dismissal to be placed in the employee's personnel file. The summary shall include the reasons for the dismissal, the names of any witnesses, and the effective date of the dismissal.
